These General Terms of Service (ToS) govern the access and use of the "Klysia Studio" SaaS (Software as a Service) solution (hereinafter "the Service"), published by KLYSIA (hereinafter "the Provider").
The Service is exclusively intended for a professional (B2B) clientele operating in the building and construction sector. Any subscription implies unreserved acceptance of these Terms.
When you use the Klysia assistant, data (text, plan extracts) are processed in a highly secure manner by our leading Artificial Intelligence infrastructure providers, strictly selected for their compliance with European standards.
Non-Training Clause: Pursuant to strict Data Processing Agreements (DPA) signed with our technology partners, your data is never used for public training or the improvement of third-party artificial intelligence models. It is processed ephemerally and encrypted solely to respond to your request, then immediately destroyed by the system (Stateless processing).
3.1 Best Efforts Obligation: The Provider is bound by a "best efforts" obligation regarding the availability of the Service and document generation. Under no circumstances is the Provider subject to an obligation of technical or architectural result.
3.2 Exclusion of Liability (Indirect Damages): The Provider shall not be held liable for indirect damages, such as: loss of revenue, loss of opportunity, commercial prejudice, or any dispute arising on a construction site (defects, delays, non-compliance) related to the use of a document generated by the platform.
3.3 Limitation of Liability: In the event that the Provider's liability is established by a final court decision, the total amount of compensation may not exceed the total sums paid by the Client for the subscription during the twelve (12) months preceding the event giving rise to the liability.
4.1 Regarding the Software: All elements of the site, the interface, source code, algorithms, and databases are the exclusive property of the Provider.
4.2 Regarding Generated Content (Output): The Client becomes the owner of the intellectual property rights to the specific documents they generate and export via the platform (Technical Specifications, reports, etc.), once the subscription payment has been honored. Klysia claims no rights over your architectural projects.
Prices are indicated in Euros. Payment is made by credit card via our secure payment provider.
5.1 Price Changes: The Provider reserves the right to modify its pricing structure at any time. This price revision may occur to reflect changes in costs related to infrastructure, licenses, APIs, and third-party technologies essential to the operation of the Service. The Client will be informed of any price modification by any written means (email or platform notification) with reasonable notice before the new prices take effect.
5.2 Suspension: Any payment failure, bank rejection, or insufficient credit balance will result in the immediate suspension of access to the paid features of the Service until the Client regularizes the situation.
The subscription has no minimum commitment period. The Client may cancel their subscription at any time from their "Agency Settings" area. Termination will take effect at the end of the current monthly period. No pro-rata refund is provided for a month already started.
The Service relies on highly secure Cloud infrastructure and AI computing technologies operated by world-class third-party providers. The Provider shall not be held responsible for service interruptions, latency, or unavailability due to outages at these third-party suppliers, internet network cuts, or any other case of force majeure as defined by French law.
Data Protection (GDPR)
Your plans, specifications, and client data are confidential. Klysia utilizes the Google Cloud Platform (Firebase) infrastructure, certified ISO 27001, SOC 1, SOC 2, and SOC 3.
Your data is stored on secure servers located in the European Union or in countries providing an adequate level of protection according to the GDPR.
When you use the Klysia assistant, transmitted data (text, plan extracts) are processed via secure Application Programming Interfaces (APIs) by our leading AI model providers.
Non-Training Clause: In accordance with the "Enterprise" B2B security protocols of our technology partners, your data is not used to train public artificial intelligence models. It undergoes ephemeral "Stateless" processing: information is processed in real-time to generate your result, then immediately purged from the processing system without being retained.
The Client has the right to access, rectify, port, and erase their personal data. These rights can be exercised by contacting the Data Protection Officer (DPO) at: support@klysia.com.
Deleting an account leads to the irreversible deletion of all associated projects and documents within 30 days (security backup period).
Klysia does not use any advertising cookies. Only technical cookies strictly necessary for the application's operation (authentication, session maintenance) are placed on your device.
